Byrd teasing Manchin again

WASHINGTON - Sen. Robert C. Byrd, who holds the record as the longest-serving member of Congress, is seriously ill in a Washington-area hospital. The West Virginia Democrat's office says the 92-year-old lawmaker has been in the hospital since late last week.

At first he was believed to be suffering from heat exhaustion and severe dehydration. But his office says in a statement doctors have examined Byrd and other medical conditions have developed. His condition is described as serious.

The statement does not name the hospital.

If Manchin had guts to get into a good old fashioned "WV Mudfest," he would select Nick Joe Rahall and then duke it out in the primary and show Nick Joe who is boss in WV.

If Manchin wanted to take the honorable path to Byrd's seat, he would nominate Shelly Moore (Capito) to the position and then clean her clock in the next election.

But, I think it is in the best interest of the state for Joe Manchin to grab the seat now and take his place next to Brother Jay and show those inside the beltway what WV is all about.

In addition to all the things stated above I will also introduce a new bill every day (of course I will have to vote "no" on them if they ever get to a vote).

These bills will range from a law prohibiting white males over the age of 12 wearing their baseball hats backwards to declaring a national holiday in honor of women who enthusiastically and skillfully perform oral sex (because these women have done more to improve the quality of life than any other group of people). I'm thinking June 15th should be "Blow Job Day."

Manchin is "too cool" to directly appoint himself. He will interview a long list of "candidates", then report back that the governor himself is the most obvious choice. After the long process, Manchin becomes senator, Earl Ray becomes governor, retiring Logan County Commission President Art Kirkendoll becomes Senator (not Senate President, of course...that will be Walt Helmick).

Well, here is where things could get interesting...

There is supposedly a state law that says if a sitting senator dies within 2.5 years of his re-election, the governor must appoint someone to fill the seat.

However, if it is longer than 2.5 years, there must be a special election, where the people elect someone to the seat.

Byrd would have been within that appointment window as of July 3. But he passed roughly one week before the window.

Presumably, this means we have situation like Mass. did with Kennedy. It's a wide open seat.

I can't confirm this law; it's just something I heard this morning.

CHARLESTON— Secretary of State Natalie Tennant says there won’t be a special election this year to fill the seat vacated by the death of U.S. Senator Robert C. Byrd.

Tennant says based on a review of state law and a 1994 state Supreme Court ruling, Gov. Joe Manchin’s appointee won’t have to face election until 2012.

At that time, there will be two races for U.S. Senate. One will be for Byrd’s unexpired term. The second would be for a full six-year term.

Tennant says the situation is unique, but state law requires appointees to file for the office and then stand for election in a primary election.

West Virginia’s primary was in May and the next is not until May 2012.
