So....

After being ignored by every station I have approached in six states over the past 7 months.

After having Warner Bros. rejected a request to use one of their songs as a show opener.

And after being told by three companies it would cost $10,000 to $20,000 to promote my show.

I have more or less decided to premiere the weekly version of "The New Oldies Show" on 360 Live in late March.

So I'm askin'....what do ya think?

You mean there was a song you wanted to use, and you actually wrote to the publisher and asked if it was okay to use their song?

What did you expect them to say?

That's what I would have done. Knowing my luck, I would have had to back up and pay thousands in royalties, though.

I would say become a real radio station or show, pay thousands in royalties in the first place, use the song (and all the others you want) because your contract agreement with the publishers says you can and don't worry about it.

This gets back to my "if you did it on a computer, you really didn't do it" quote. This is a day and age when anybody can record a song, promote a song, play a song to thousands, advertise a song, have their own radio shows to play songs, and then use the very same instrument as an outlet to complain all they want to about the music, radio stations, artists, record companies, or people who have a differing viewpoint about any of the items I just mentioned. One of the things that I am the evermost thankful for is having been brought up on REAL radio stations, trained by REAL radio people, with a desire to provide the folks with REAL quality radio and entertainment, that would REALLY make their day and change their lives. An attractive woman on the internet is not a wife, fantasy baseball is not major leagues, a blog is not a newspaper or magazine, and an internet radio station is not a radio station.

I'm sorry to report this, but even the stations that many consider to be REAL stations today are just shells of what it took to be a legitimate broadcaster in the pre-computer days of radio. I will admit that I have had to have "refresher courses" in programming automation and scheduling programming. But give me a hand-typed program log, two turntables or two cd players, a clock, mic, cart machines, and the other studio peripherals that a real broadcaster needs and I'll blow your computers away for four hours.

I'm sure most of you computer broadcasters do a really good job...I've heard some really great things out there. But just realize you are doing it because you want to do it and have made yourself a way to do it with all that you have purchased (computer, internet service, space on a website for broadcasting, etc.). Real broadcasters are made when other real broadcasters give them an opportunity because they feel the individual has the desire, drive, and talent to be able to do it...

My point is:

Why EVER ask permission to use a song---if you're indeed registered with ASCAP--SESAC---or BMI?

ANY request to USE a song will be met with total defeat from the onset.

NOBODY---I MEAN---NOBODY is going to give permission to use ANYTHING within the realm of a company the size of Warner Bros. They have zero idea in what context it will be used, and are certainly not going to investigate it.

Example: Limbaugh using the intro to "Back to Ohio" by the Pretenders for his entire career. Chrissie Hynde HATES it. HATES!!! Limbaugh would've gotten a big fat "NO" even at the beginning.

Frankly, I don't understand going to the trouble of asking anything these days. Nobody does that. NOBODY! My GOD the entire industry is over-flowing with this.

If morning shows, or talk, or whatever had to sit down today and write a letter or make a call to every clip producer---whose clip they wanted to use on their show---they would automatically be a big fat "NO!" across the board and THEN------you'd be liable with that being on record. PLUS-----there would be virtually no radio any longer.

I gotta wonder--------are you NEW?

Yes, if I were working at a station I would not even think of a theme song license until several stations picked it up and I was making money on it, if then.

And I did "request a license" thru the Warner/Chappell web site (basicaly to see what kind of price they would hang on it and not expecting to get it) and after two weeks the 'status' box simply said "rejected".

I can get a jingle package under three grand that would do the same thing....if I had three grand.

My question is still about 365 Live. Would anyone hear it? Would a PD go listen if told it was there?

Hell, I've even offered to buy time and still can't get even a "F... Off" from any of the locals.

Listeners don't care about whether or not a station is "real", as long as the content entertains them.

In a fast approaching world where 5,000 stations are available to people on their cell phones, you're just another stream. But even in that world, you will find most of the available audience listening to only a handful of streams.

One browse of Shoutcast proves that. There are stations with thousands of listeners who even sell air time that are not "real" in this definition. But, what else would you call them? They sound pro, they're just not ota.

The internet is a level playing field. If you have great content, get it out there however you can.

I am a product of and a fan of both worlds. I love and deeply miss "old radio", having worked there and grown up with it, but about the only place you can find individuality and creativity anymore (Exception: Major, Major OTA Markets) is on the 'net.

Why worry about asking permission to play a song as your theme. As long as the provider your radio stream is on pays the proper fees it will already be covered. You mentioned Live365.com, well they are licensed to play any and all music so there is no problem at all.
