An Internet Question (for you lawyers)

My little show is sourced analogue, meaning there are no "tags" on the music. My inquiry about streaming the program ran into high costs for BMI, ASCAP and SoundExchange with all the "hosts" I contacted requiring music "tags". SoundExchange did indicate a "Quarterly Report" like OTA stations do may be acceptable. But still it was all too expensive to do.

Now comes a request for the show from an internet radio source in another country.

Thus the question....do I dare send it to them?

If you aren't streaming the show in the US, then the only issue would be the foreign laws--but that would be a problem for the originating site in that country. You are just a program supplier now.

Utilize caution, lastone. Get the requesting company from the foreign country to sign an agreement promising to pay all fees associated with the music included in the program and also to agree that any such fees are their responsibility (and not yours). Cover your ass big-time on this; better safe than sorry.
