As of 2005, Byrd was the only NON millionaire in the Senate.

If I understand the situation correctly, the following is slated to happen:

-Governor Joe Manchin will, at some point, appoint a successor for the U.S. Senate seat that had been held by Robert Byrd. That person will be sworn in and take office.
-There will be two elections in 2012; one will determine who will fill the final five weeks of Byrd's term, and another will determine who will be Senator beginning when the new six-year cycle for the seat begins. It's unclear to me when exactly in 2012 the election for the final five weeks would be, but the one for the six-year term would take place on November 6, 2012.
-As far as I can tell, both elections could possibly end up on the same ballot, which would cause all kinds of confusion and bring (more) mockery to West Virginia from the rest of the country.

Hopefully Governor Manchin will act in the best interest of the state and appoint Jay Nunley to the vacant Senate seat. Jay has already promised not to run for re-election, not even for that five-week slot, leaving the path open for Manchin to run for it in 2012 and not having to vacate the Governor's house prematurely.

Jay would be a welcome change on the senate floor in my opinion, I totally support him as a short term replacement till the next real election!!!!

Manchin will appoint himself.

Despite the denials.

He's the only member of the West Virginia branch of the National Socialist Democrat Party that has a chance of beating Shelly More Capito in the 2012 general election. Emperor Barack Hussein Obama (mmm mmm mmm) will have no coattails at all in 2012 (an election I expect to be a repeat of 1980, people will be counting down the days until they can remove this utter disaster from office, same as they did Carter), and worse, WV is a state destined to be utterly obliterated if "Cap and tax" is passed in any form. Manchin is the only state NSDP member who has any credibility for opposing Cap and Tax. Mollohan lost his primary BECAUSE of his support for Cap and Tax.

As for Robert C. Byrd... To join an organization like the KKK in any way, shape or form is to have a rotten to the core soul. God may well forgive him, but I don't. Someone with that much hatred in his heart for his fellow man for no reason other than the superficial (skin color) as to join (and become a leader) in a group that committed many violent and murderous acts was not nor ever could be considered a good person.

Which is why he naturally was a socialist democrat, promoting the welfare state, which became the late 20th century revival of the slave plantation. The plight of blacks (and everyone else) is worse today because of the welfare state.

I look forward to the day that this evil man's name starts coming off the billions of dollars worth of taxpayer funded edifices named after him.

According to WV law, the seat SHOULD go up for election this November (because the seat is vacant more than 2.5 years before the term ends). If Byrd had lived until July 3, Manchin could legally appoint someone to fill the rest of the term (until 2012). Of course, this being West Virginia, and National Socialist Democrats not being the least bit interested in the law, Manchin will delay until July 4 to declare the seat vacant and then appoint himself.

Here are the scenarios:

1. Manchin follows the law, declares the seat vacant, appoints some stooge to run in 2010 (it will be someone that is no threat to him in the 2012 primary), this person loses to Shelly Moore Capito, who then opposes Cap and Tax. Manchin runs in 2012 for Senate and hopes for Obama coattails. Bad scenario, least likely to happen.

2. Manchin subverts the law, waits to declare the seat vacant so he can appoint someone for the full remaining time of the term (until the 2012 election), appoints a stooge that is no threat to him, and the same scenario as above plays out with Manchin winning in the primary to face Capito in the general, hoping again to ride Dear Leader's (nonexistant) coattails. Also a bad scenario, only slightly better for him than the above one.

3. Manchin subverts the law, delays declaring the seat vacant so as to avoid a 2010 election, appoints himself (he will declare that it's in the best interests of West Virginia, cry a lot of John Edwards like crocodile tears, then take the seat until 2012), votes against Cap and Tax, is disowned by the NSDP establishment (which is hard left) and limps into a 2012 general election in which he faces Shelly Moore Capito in what is sure to be a statewide landslide AGAINST Dear Leader (aka Jimmy Carter II). Most likely scenario.

The end result: I believe that whatever happens, Shelly Moore Capito will end up winning this Senate seat. WV is starting to go the way that Kentucky did 15 years ago, in electing Republicans to Federal office in it's own self interest, even if the state is still dominated by democrats. If the Obama agenda succeeds, the coal industry is dead. Things in this state will get to be so bad that the ONLY industry left will be welfare distribution.

Why would it take several days to "declare" the seat vacant?

If this law is, in fact, the law, then the seat became vacant yesterday. It should be an open seat, with a special general election in the fall. Almighty Joe needs to wait until 2012 and run like anybody else if he wants to become senator.

Will anybody dare stand up to the fiefdom and, um, point out what the state law actually says?

One of the major reasons given for continuously re-electing Byrd was the enormous amount of power he had in congress to "bring home the bacon".

Between Byrd's death and Mollohan's primary defeat last month, the state has lost two big porkers, and will have far fewer friends in high places. We are "on our own" now more than we have been in decades.

I hope that the state's Democrats remember that they are an anomaly to the national Democrat party, which is now dominated by the Progressives and the rabid environmentalists.

Coal, God, guns, abortion, gay rights, traditional values...heck, four-wheeling; take your pick. WV stands for everything they hate. They and Obama are dead serious when they say they want to bankrupt the coal industry and make everyone drive electric golf carts.

Nor do they care what we say or think, or what the economic consequences will be. We are a mere speed bump to them fulfilling their social and environmental agenda. The ends justify the means.

This state needs to take serious thought as to who its friends and enemies are, and who will best represent its interests going forward.

I'm tempted to take that bet. However, if the economy turns around, if the right wing machine stays nutty as hell, if the Republicans nominate Palin or another joke, or if a third party tea bagger type splits off some votes President Obama wins. If two or more of those things happen he wins in a landslide.

Also, I was serious about that traditional values thing. No one has yet to define those to me. I have a suspicion it is just a focus group tested, bullshit, politician's phrase designed to "get next" to middle class moderate white people. I think it's the same thing as that "War On Christmas" horseshit.

Being a middle class moderate white people, I also get disturbed by the doings of the fringe left and the seeming degradation of our culture and country. However, I recognize the fringe left have no ability to do, well, anything, and know the truth is the country and culture are changing in many ways but, they are not being degraded. So, bullshit like "Traditional Values" and "War on Christmas" doesn't work with me.

I could be wrong about this. If someone can define traditional values without it being an extended version of the same bullshit I will know.

I agree that this just a catch phrase, more or less. I also agree that this structure is an unrealistic expectation for many.

In this state, however, blood lines are its own currency. The family is very important. Even if the traditional structure has been eroded, it's still the ideal many strive for.

That's the best I can explain it.

The wild cards are the economy/unemployment, Afghanistan, and the oil spill. If he can successfully mend these issues before the election, he will probably win re-election--barely.

The other one is if the Tea Baggers and the GOP establishment can't agree on a candidate, and they drag out the primaries through the late spring and summer and wind up with a battered, inferior candidate.

Or if there is a third party candidate.

Or if they run Palin.

I think the first scenario is the least likely. This economy and unemployment isn't turning around anytime soon... Afghanistan has quagmire written all over it. And he's taking a huge risk protecting his union buddies from all of those scab booms being offered by other countries. I don't think the Gulf Coast residents will take it too kindly when they find out that protecting big labor is more important than protecting their livelihoods from ruin.

There will be no third party candidate. The "Perot effect" will be remembered for a long, long time.

And Palin's not running in 2012.

I disagree because the fringe left currently has more power than they ever have... And Obama is the most leftist/Progressive president we've ever had.

He just proved at the G20 Summit that he's economically to the left of Europe, for crying out loud...

And he does hate coal. He's already using the EPA to hold up mining permits.

With Emperor Zero confiscating industries and shaking down companies for 20 billion dollar slush funds, along with the uncertainty he keeps generating with the inevitable tax hikes of 2011 and increased regulation, the economy has less chance of improving before the 2012 election to any significant degree (which would mean getting back to 2006-7's level of prosperity) than I have of Jessica Alba and Megan Fox showing up on my front doorstep asking me to father their kids.

Economic prosperity only happens where government is predictable because there is a rule of law. Well, Obamagovernment is predictable as well. It's a system of crony capitalism, a hallmark of National Socialist theroy, but in such a way as to dissuade captital investment.
