Crack offenders' sentences reduced ....... March 11, 2008

(Or how being Politically Correct can get you killed)

HUNTINGTON -- A convicted crack cocaine dealer is out of prison thanks to a recent change in federal sentencing guidelines.

Delmar "Peanut" Tucker, 30, was released from the federal Bureau of Prisons on Friday, according to the bureau's Web site. The developments follow two recent decisions by the U.S. Sentencing Commission. It reduced the recommended prison sentence for people convicted of crack cocaine offenses. The commission then decided to make the new rules retroactive, and that ruling took effect March 3.

Tucker received 30 months off his sentence, the largest reduction granted so far locally, as of Tuesday morning.

Supporters say changing the guidelines reversed years of discrimination and brought punishments in line with penalties for other drugs, mainly powder cocaine.

As of Tuesday morning, court officials had identified 41 defendants being considered. Each of their cases are based in Huntington. That number is expected to increase.

HUNTINGTON -- Huntington Police arrested 26-year-old city resident Joseph Ira Patterson III at 8:30 a.m. Friday, hours after he and an accomplice allegedly robbed and assaulted two victims.

According to a release from Sergeant John Williams, around 4:25 a.m. in the 1200 block of 26th Street, three victims reported that two black men approached their vehicle with pistols. The victims said the men forced their way into the car and drove around with the them, trying to ascertain if they had any money.

The victims stated they were taken to several locations, and two were sexually assaulted by one of the men.
Patterson is charged with felony counts of kidnapping, armed robbery and sexual assault. He is being held in the Western Regional Jail on $150,000 bond.
