85 year old man is dying... and so he sues??

CHARLESTON, W.Va. -- Gordon Conley was a chemical plant operator and electrician for Union Carbide for 37 years, during which he was exposed to asbestos dust and fibers. Today, Conley, is terminally ill from malignant mesothelioma, a deadly form of cancer caused by asbestos exposure.

He's been awarded a substantial sum in compensation for his workplace-related disease, but he might not live long enough to see it.

Wells Fargo Disability Management, a third-party administrator that handles work injury claims in West Virginia, plans to pay Conley, 85, his award over a period of several years. The problem with that, said Conley's lawyer, E. This is why America is going to lose everything to the Chinese: THE MAN IS 85 YEARS OLD! Most of us reading this will NEVER make it to 85 years! SOMETHING will kill us all, and if you're lucky enough to live to see 85, I'd say you had a hell of a run! Suing an American company on your way out at THAT age is outrageous! But don't worry, there will be plenty of Chinese companies for your grandchildren to work for...

What a coincidence that I just posted in this thread a few days ago...

My grandfather was 91 when he passed away in a nursing home. He sued Union Carbide in his 80s for asbestos exposure. After years of appeals, he finally got settlement checks.

My opinion is them knowing his age, they stalled with appeals as long as they could hoping he would pass away. By the time he got them, he could no longer enjoy them.

The kicker is that even though he died in 2000, there is a bank account somewhere out there with mine and another survivor's name on it, to be split 50/50. The checks have continued to pile into this account after his death, though I have no idea where it is, how much, or if I will ever see anything out of it.

I have no problem with suing companies after the fact for something like asbestos exposure, which many companies including UC knew was dangerous for years but continued to expose their employees to it. I watched my grandfather struggle for every breath in his final years...

It sucks though when trial lawyers make a mockery of the justice system with all of the "hot coffee" lawsuits. It also sucks that these same sharks benefit so much from legit lawsuits like my grandfather's.

Dying during "working years", leaving a family behind to fend for themselves is completely different than dying of "old age". All of this is due to LAWYERS, convincing these old men and their families that they are somehow entitled to lot's of money, even if they were going to die of old age anyway.
