WV lawsuits: is there ANYTHING they cant do?
Train conductor files lawsuit over goose attack
A CSX Transportation Inc. conductor is suing the railroad, claiming a goose attacked him on the job.
Aaron E. Richards claims he was assigned to perform a brake test on a train in the Keyser Receiving Yard near Ravenswood at 1:15 a.m. on April 23, 2005.
"As Plaintiff performed the required inspection, a goose which was previously known by Defendant to have nested in its yard area, suddenly jumped out from under one of the railcars, striking Plaintiff, and causing him to fall resulting in injuries and damages," according to the lawsuit filed Feb. 4 in U.S. District Court for the Southern District of West Virginia at Huntington.
"The injuries and damages sustained by Plaintiff were caused by the negligence of Defendant in violation of the Federal Employers' Liability Act," the lawsuit alleges.
"As a result of the negligence of Defendant, Plaintiff has suffered pain in the past and will suffer pain in the future; has incurred expenses for medical treatment, and will incur further like expenses in the future; has suffered loss of earnings and impairment of future earning capacity; and has suffered loss of his enjoyment of life, all to his injury and damage," the lawsuit alleges.
Richards seeks a judgment against CSX for more than $75,000, plus interest, and demands a jury trial.
W. Michael Frazier, Richard's Huntington attorney, did not return a call seeking comment. CSX did not immediately return a call seeking comment.
