CHARLESTON, W.Va. - West Virginia retailers could soon face misdemeanor charges for denying people with inflammatory bowel disease access to employee-only bathrooms.
The Restroom Access Act passed the Senate and is pending in the House. It is meant to prevent people with certain disorders from soiling themselves in public when a bathroom is otherwise available.
The bill would require retail establishments to make employee-only restrooms available during normal business hours to people with bowel control problems. Violators would face a $100 fine.
Not just anyone could demand access to a store restroom.
People with the targeted diseases would first need to obtain, carry and show the retailer a Restroom Access Card issued by the New York-based Foundation for Clinical Research in Inflammatory Bowel Disease.
